External Adjudication Orders

Section 75 of the Freedom of Information and Protection of Privacy Act and section 96 of the Health Information Act allow for an external adjudicator to be appointed to rule in place of the Commissioner.

Although the OIPC makes every effort to ensure that all information posted on the website is accurate and complete, the OIPC cannot guarantee its integrity. If there is any discrepancy between the information posted on our website and the original paper versions, the original paper document is authoritative.

The following external adjudication orders have been issued:

  • Adjudication Order No. 10
    June 28, 2016. The OIPC was found to have properly excluded records requested by the applicant as the records related to the statutory functions of an officer of the legislature under the FOIP Act.
  • Adjudication Order No. 9
    September 10, 2015. The OIPC was found to have properly exempted records.
  • Adjudication Order No. 8
    April 14, 2015. Applicant's request for review on decision by Alberta Corporate Human Resources and Alberta Justice was found to not warrant an inquiry.
  • Adjudication Order No. 7
    August 12, 2009. Adjudicator concluded that the Commissioner did not act improperly in a matter involving Tesco Corporation.
  • Adjudication Order No. 6
    January 30, 2009. This matter was upheld on judicial review.
  • Adjudication Order No. 5
    August 6, 2004. Adjudicator confirmed all but one of the decisions of Grant MacEwan College with regard to information the college provided in access requests.
  • Adjudication Order No. 4
    October 3, 2003. Adjudicator ordered Alberta Justice to disclosed some of the 68,822 records related to the Stockwell Day defamation lawsuit.
  • Adjudication Order No. 3
    March 13, 2003. Adjudicator confirmed that Alberta Justice was required to refuse access to the records under section 27(2) of the FOIP Act and authorized to refuse access under section 27(1)(a).
  • Adjudication Order No. 2
    May 24, 2002. Adjudicator ordered Alberta Justice to reduce fees from $59,571 to $2,500 for one applicant and from $60,696 to $500 for another applicant.
  • Adjudication Order No. 1
    May 29, 1996. External adjudicator released decision into access request for Alberta Federal and Intergovernmental Affairs records.
