How to File a Concern with an Organization

The Commissioner is authorized under section 59(2) of the Freedom of Information and Protection of Privacy Act, R.S.A. 2000 c. F-25 (“FOIP”), section 91(2) of the Health Information Act, R.S.A. 2000, c. H-5 (“HIA”), and section 41(2) of the Personal Information Protection Act, S.A. 2003, c. P-6.5 (“PIPA”), to disclose information necessary to conduct an investigation or inquiry.  See also sections 1(m), 4(1)(d) and 60 of FOIP, section 92 of HIA and section 42 of PIPA.

Effective July 1, 2010, the Information and Privacy Commissioner of Alberta is implementing revised procedures when a new case file is opened by this Office:

 

ü      An individual requesting a review or filing a complaint must complete and submit, with all applicable attachments, a “Request for Review” form, “Complaint” form, or “Third Party Request for Review” form, as appropriate.  The “Request for Review” form and the “Complaint” form apply to FOIP, HIA and PIPA, whereas a “Third Party Request for Review” is only available under FOIP.  The “Request for Review” form, “Complaint” form, or “Third Party Request for Review” form, as the case may be, and all attachments will be sent to the respective public body, custodian or organization.

 

ü      Complaints regarding the collection, use and/or disclosure of personal/health information will be sent to the public body/custodian/organization against which the allegation is made at the time the complaint is accepted by this Office, as indicated above.

 

ü      Each of the “Request for Review” form, “Complaint” form and “Third Party Request for Review” form requires that the individual provide an address for service where the individual is to be contacted by this Office and all other parties to the review or complaint for all purposes related to it.  Each party’s address for service will be provided to all other parties to the review or complaint, as indicated above.  If an individual wishes to change their address for service at any point during the review, they must complete a “Change of Contact and/or Address for Service” form, forward a copy to all parties to the review or complaint, and forward the original to this Office.
