Questions & Answers

What are the rules relating to an employer implementing a video surveillance system in the workplace?

There is no specific mention of video surveillance in PIPA; however, the collection, use and disclosure of personal information is subject to this Act. Very generally, employers should have compelling concerns which would justify monitoring; the monitoring should be done in the least intrusive manner (eg. no video cameras in locker rooms or washrooms etc.); and notification should be provided to employees as to the reasons, use and possible disclosure or consequences of the information being collected. The Office of the Federal Privacy Commissioner of Canada also provides on their website some information around best practices for video surveillance. Their website is www.privcom.gc.ca
