How does PIPA apply to employment applications? Does a company have to put a privacy disclaimer on an employment application?
PIPA will apply to personal employee information, unless your organization is a non-profit organization (which is defined in section 56 of the Act).
Personal employee information means personal information that is reasonably needed to establish, manage, or end a work or volunteer relationship. In that case employment applications would fit that description. There are special rules to follow for employee information and they can be found in sections 15, 18, and 21 of PIPA.
There is no specific requirement, however, to put a "privacy disclaimer" on employment applications; but an organization may wish to inform applicants of what their information will be used for, and who it may be disclosed to in the processing of their application.
