Investigations & Reviews

Prior to requesting a review of an organization’s actions by the Commissioner, an individual should exhaust all means of resolving their concerns directly with the organization. Under PIPA, the Commissioner may require that an individual has exhausted all possibilities for resolution with the organization prior to accepting a request for review or a complaint, when it is reasonable to do so.

Upon acceptance of a request for review, a copy of your letter will be provided to the organization and to anyone else the Commissioner believes is affected by the request.

The Commissioner will assign an officer from his Office to try to facilitate an agreement between you and the organization. If the matter cannot be resolved through the process of mediation, you may request the matter proceed to inquiry. The Commissioner will then decide whether an inquiry will be conducted.

As with reviews, the Commissioner may appoint a member of his staff to investigate complaints that information has been collected, used or disclosed in violation of PIPA. An investigation into your complaint will be conducted and the findings will be communicated in a letter to the parties or, in some cases, a formal Investigation Report which has been accepted by the Commissioner.

At this time, the Information and Privacy Commissioner does not accept requests for review or complaints via email.
