External Adjudication Orders
Section 75 of the FOIP Act and section 96 of the HIA allow for an external adjudicator to be appointed to rule in place of the Information and Privacy Commissioner.
Seven external adjudication orders have been issued.
Adjudication Order No. 7 (August 12, 2009 Veit J.)
Adjudication Order No. 6 (January 30, 2009 Wittman J.) Upheld on judicial review. See 2009 ABQB 546.
Prohibition order granted. See 2011 ABCA 36.
Adjudication Order No. 5 (August 6, 2004, Martin J.)
Adjudicator confirms all but one of the decisions of Grant MacEwan College with regard to information the College provided on access requests.
Adjudication Order No. 3 (March 13, 2003, McMahon J.)
Adjudicator confirms that Alberta Justice is required to refuse access to the records under section 27(2) of the FOIP Act and authorized to refuse access under section 27(1)(a).
Adjudication Order No. 4 (October 3, 2003, McMahon J.)
Adjudicator orders Alberta Justice to disclose some of the 68,822 records relating to the Stockwell Day defamation lawsuit.
Adjudication Order No. 2 (May 24, 2002, McMahon J.)
Adjudicator orders Alberta Justice to reduce fees from $59, 571.00 to $2,500.00 for one Applicant and from $60,696.00 to $500.00 for another Applicant.
