Investigations & Reviews

The Commissioner has extensive powers to investigate requests for review and complaints. He can require that any record be produced for his examination.

You may ask the Commissioner to review a public body’s response to your access request. The Commissioner must provide a copy of your request to the appropriate public body and to anyone else the Commissioner believes is affected by your request. The Commissioner must also provide to all parties a summary of the review procedures and an anticipated date for the decision.

The Commissioner may assign a member of his staff to review whether a resolution could be reached between you and the public body. If a resolution cannot be reached, you may ask that the matter proceed to inquiry. The decision to conduct an inquiry rests with the Commissioner.

As with reviews, the Commissioner may appoint a member of his staff to investigate complaints that personal information has been collected, used or disclosed in violation of the FOIP Act. The findings of the investigation and any recommendations may be communicated to parties in the form of a letter or an investigation report. If you are not satisfied with the findings and the recommendations of the investigation, you may ask that the Commissioner hold an inquiry. The decision to conduct an inquiry rests with the Commissioner.
