After a decision is made by the Registrar to allow or deny access to personal driving and motor vehicle information, AMVIR requires that notification of that decision be made on the Registrar’s website. Within 60 days of the notification, any person may request that the Commissioner review the Registrar’s decision either to grant or deny access by completing and submitting a Request for Review form with applicable attachments. The Commissioner cannot act upon a request for review received outside of the 60 day period.
The Commissioner’s authority to conduct a review and hold an inquiry is contained in Part 5, Division 1.1, of the Freedom of Information and Protection of Privacy Act. The Commissioner’s authority is restricted to review a specific decision to grant or deny access for a specific purpose or purposes by the Registrar.
The Commissioner will generally hold an inquiry and issue an Order containing the Commissioner’s decision on issues set out in the request for review. The Commissioner may refuse to hold an inquiry if the subject-matter of a request for review has been dealt with in a previous Order or if circumstances warrant refusing to conduct an inquiry.
A request for review must be received, in writing, by the Office of the Information and Privacy Commissioner within 60 days of the notification on the Registrar’s website. At this time, the Information and Privacy Commissioner does not accept requests for review via email.
